Terms & Condition's 

Full Terms & Conditions can be found in your signed contact, a copy of which can be requested at anytime.  This is a brief overview for your information. The relevant booking fee is payable by the Client in full at the time of booking in order to secure your appointment or date of event. This is non refundable. Payments can be made by PayPal via email address, bank transfer, cash or cheque. Please note, if paying by cheque your appointment or date will not be secured until your cheque has cleared. There is a 14 day cooling off period once you have paid your booking fee in which you can cancel and have this returned. After the 14th day of booking the Client may cancel a session at any time, but in doing so shall forfeit any non-refundable monies paid. Remaining balance is due 7 days prior to your event or 28 days prior to wedding date.

In the unlikely event that Michelle Louise Photography is injured or becomes too ill, or has an extreme emergency that prevents them from photographing the event, the photographer will make every effort to reschedule the event or instruct another Photographer with a similar portfolio & style. If this is not possible ie. Wedding – then any monies paid will be returned in full, including Booking fee.

All final images are selected by MichelleLouisePhotography and fully edited before presenting to Client. Additional edits are carried out at the discretion of MichelleLouisePhotography, and may incur an additional charge. Images that are not selected for the gallery are deemed not suitable, such as incorrect exposure or out of focus, and will be permanently deleted from file. RAW images will not be provided to the client in any circumstances.

A low resolution preview will be available within a few days of the session. Clients are free to tag and share this as they wish. A password protected, on-line gallery of proof images will usually be available within 2 weeks for events or 8 weeks for weddings (up to 12 in busy periods) of the session date.

Events can except anywhere from 100-300 images depending on length of time hired, interaction and co-operation of guests. Weddings can range from 100-800 depending on which package you decide on. MichelleLouisePhotography will do everything they can to capture quality images but cannot take responsibility for external factors that may effect working conditions and my ability to capture required shots – such as Smoke Machines used by DJ’s, strobe or coloured flashing lighting. These factors can and will affect the overall shot eg. foggy and/or out of focus images.

Michelle Louise Photography will store your session image files at their offices for a period of 12 months only.  When digital images have been purchased & received they should be backed up by the client immediately and MichelleLouisePhotography is no longer responsible for any digital files once they are taken by the client.

If you choose to have your digital files or images printed at a place of your choice Michelle Louise Photography cannot be held responsible for the quality of the printing or the quality of the products. I strongly advise against using high street stores as they will hugely distort your images. It is recommended prints and products such as canvases are purchased directly through Michelle Louise Photography or your online gallery to ensure quality.

Copyright

Michelle Louise Photography retains copyright to the photographs, video footage and BTS footage, and hereby grants the Client unlimited but non-exclusive rights to use or re-produce the photographs for which the client pays. Michelle Louise Photography reserves the right to use any photographs in any form such as, but not limited to, the use in advertising, on all existing, new and future social media platforms portfolio, publication or promotion, of its work, reproduction and copyright. All images are copyrighted to Michelle Louise Photography even those that have been purchased by the client.

Equipment

MichelleLouisePhotography takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event photographs either on electronic media (memory cards or hard drives) being lost, stolen or destroyed for reasons within or beyond MichelleLouisePhotography’ control, the latter’s liability is limited to the return of all payments received for the package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

Where there is a technical failure of equipment, whether camera equipment or media such as memory cards, hard drives, USB media or any other storage device in use at the time of the photography session Michelle Louise Photography shall not be held liable for such failure that is out of Michelle Louise Photography’s control. Reasonable care shall at all times be taken to ensure equipment is maintained, cleaned and in full working order prior to any sessions or event taking place, any failure thereafter shall not present any liability on Michelle Louise Photography for loss of images. MichelleLouisePhotography carries backup equipment which shall consist of one additional camera body and one lens with ancillary equipment such as batteries.
