Terms & Condition's 

The relevant booking fee is payable by the Client in full at the time of booking in order to secure your appointment or date of event. This is non refundable. Payments can be made by PayPal via email address, bank transfer, cash or cheque. Please note, if paying by cheque your appointment or date will not be secured until your cheque has cleared. There is a 14 day cooling off period once you have paid your booking fee in which you can cancel and have this returned. After the 14th day of booking the Client may cancel a session at any time, but in doing so shall forfeit any non-refundable monies paid. Remaining balance is due on the day of the shoot or 28 days prior to wedding date.

In the unlikely event that MichelleLouisePhotography is injured or becomes too ill, or has an extreme emergency that prevents them from photographing the event, the photographer will make every effort to reschedule the event or instruct another Photographer with a similar portfolio & style. If this is not possible ie. Wedding – then any monies paid will be returned in full, including Booking fee.

All final images are selected by MichelleLouisePhotography and fully edited before presenting to Client. Additional edits are carried out at the discretion of MichelleLouisePhotography, and may incur an additional charge. Images that are not selected for the gallery are deemed not suitable, such as incorrect exposure or out of focus, and will be permanently deleted from file. RAW images will not be provided to the client in any circumstances.

A low resolution, watermarked Facebook preview will be available within a few days of the session. Clients are free to tag and share this as they wish. A password protected, on-line gallery of proof images will usually be available within 2 weeks of the session date. At busy times or over the Christmas period this may take longer than 2 weeks, and you will be advised of this at your session. The gallery will contain anywhere from 10-30 images. In both instances, this number is dependent upon a number of factors, including the willingness/co-operation of subjects. If the total number of images is above or below the average amount, no credit will be given or additional charges applied. Images are processed with a mix of both colour and black and white, although some images will not be suitable for black and white conversion.

Events can except anywhere from 100-300 images depending on length of time hired, interaction and co-operation of guests. Weddings can range from 100-800 depending on which package you decide on. MichelleLouisePhotography will do everything they can to capture quality images but cannot take responsibility for external factors that may effect working conditions and my ability to capture required shots – such as Smoke Machines used by DJ’s, strobe or coloured flashing lighting. These factors can and will affect the overall shot eg. foggy and/or out of focus images.

Michelle Louise Photography will store your session image files at their offices for a period of 12 months only.  When digital images have been purchased & received they should be backed up by the client immediately and MichelleLouisePhotography is no longer responsible for any digital files once they are taken by the client. For the packages were you receive a USB, this should be checked and backed up as soon as you receive & faulty a USB must be be reported and returned within 14 days. After this time MichelleLouisePhotography has no responsibility regarding the USB for lost or damage etc.

If you choose to have your digital files or images on your USB printed at a place of your choice MichelleLouisePhotography cannot be held responsible for the quality of the printing or the quality of the products. I strongly advise against using high street stores such as Max Spielmann as they will hugely distort your images. It is recommended prints and products such as canvases are purchased directly through MichelleLouisePhotography or your online gallery to ensure quality.

All orders are presumed to have been received in good condition unless the Client notifies MichelleLouisePhotography in writing of any discrepancy or error within 24 hours of receipt.

Any products should be inspected upon collection from client. Once the client agrees to take the products they are accepting they are in satisfactory condition. Once digital files have been transferred either via their online gallery, Dropbox, email or USB they are nonrefundable.

All USB containing high-resolution images will be delivered to the Client within 3 weeks of the order date. Delivery for prints, albums or any other additional orders may vary and will be advised at time of ordering. MichelleLouisePhotography shall not be responsible for delays due to supplier interruptions or the postal service.

All portraits, books, albums, frames, etc. are non-refundable. Orders cannot be cancelled due to the custom nature of the products as they are bespoke orders. Orders are made to the Client’s personal specification, (i.e. image number, print size, frame style, etc.), the Client does not have the right to a cooling off period. By placing an order with MichelleLouisePhotography you are committing to buy the ordered products. Proofs for books and albums layouts will be sent to the client prior to ordering final product for confirmation.

Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error. Due to the digital nature of the product, images discs cannot be returned.

Copyright

MichelleLouisePhotography retains copyright to the photographs, and hereby grants the Client unlimited but non-exclusive rights to use or re-produce the photographs for which the client pays. MichelleLouisePhotography reserves the right to use any photographs in any form such as, but not limited to, the use in advertising, portfolio, publication or promotion, of its work, reproduction and copyright. All images are copyrighted to MichelleLouisePhotography even those that have been purchased by the client.

Copying, scanning or print screening any images unless agreed is strictly prohibited. in any form without the prior consent of MichelleLouisePhotography. The Client may not alter or add to or manipulate a picture by any means, such as Instagram filters, or reproduce a picture in whole or in part as an element within, or as a montage with, another picture without MichelleLouisePhotography’s written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the Client by MichelleLouisePhotography only when digital negatives are purchased and paid for in full by the Client.

Equipment

MichelleLouisePhotography takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event photographs either on electronic media (memory cards or hard drives) being lost, stolen or destroyed for reasons within or beyond MichelleLouisePhotography’ control, the latter’s liability is limited to the return of all payments received for the package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

Where there is a technical failure of equipment, whether camera equipment or media such as memory cards, hard drives, USB media or any other storage device in use at the time of the photography session MichelleLouisePhotography shall not be held liable for such failure that is out of MichelleLouisePhotography’s control. Reasonable care shall at all times be taken to ensure equipment is maintained, cleaned and in full working order prior to any sessions or event taking place, any failure thereafter shall not present any liability on MichelleLouisePhotography for loss of images. MichelleLouisePhotography carries backup equipment which shall consist of one additional camera body and one lens with ancillary equipment such as batteries.
